Contrary to many other jurisdictions Germany provides a specific Act on Drug advertisement (Heilmittelwerbegesetz), containing a specific framework of legal requirements on the advertisement particularly of drugs, medical products and cosmetics. In addition, also EU Regulations need to be observed in the light of designing your product packaging, labels, and other advertising material.
Particularly, by providing the following services:
- Evaluating your advertisement material prior to market entry
- Protecting advertisement material through IP rights where available
- Searches on registrability, particularly on distinctive character
- Examining clinical papers and other expert opinions on its strength to support health related claims
- Filing Protective Brief in anticipation of potential request for preliminary injunction
- Litigation before all competent courts on issues of unfair competition and misleading wordings
- Negotiating settlements, use-up periods, damage claims
